Diyala PC announces autonomy

Iraqiya list in Diyala announced autonomy for the province today reports (AKnews).
Hassan Jihad in the Provincial council told AKnews that by the majority of members votes autonomy for the province was declared and now preparations are under way to send to the parliament to be passed.
he said "we as the kurdish members in the council do not oppose this declaration but we have set conditions that the areas that are under article 140 should not be included in this region but to go back onto KAR (Kurdistan autonomous region) .

Hassan Jihad revealed that Diyala PC has agreed to exclude the kurdish town of Khanaqin in their region and to implement 140 for the Khanaqinians to vote in a referendum so that it becomes official .


well its good news i am hearing the Sunnis want their region to have 0 problem with KAR therefore they now want 140 implemented .

forgive my ignorance heval Alan , I'm yet to read the Iraqi constitution :D

1-is this allowed under Iraqi constitution and if so , what is the process ?
2-Can any city or group of cities declare an autonomous region if their elected members voted by majority to have an as autonomous region ?
3- is referendum a requirement ?
4-what if it is rejected by Iraqi parliament ?

Wait they voting on a referndum or exclude them?

yes this is constitutional . only the "provincial council" members have the authority to declare autonomy and only by getting 80% of total votes which in their case they did. what will happen is the request will be forwarded to Baghdad and sent to the election commission to set preparations for a referendum for the province . Iraqi parliament has no power to reject it as it is in the constitution and the Pres. has the power to forward it to election commission to bypass the parliament that is why also a delegation from Salahadin PC visited (Talabani) few weeks ago and gave him the request directly for him to forward it to the E.C.

Kurdistan Blocs Coalition supports Diyala's demand for auton

DIYALA, Iraq, — The Kurdistan Blocs Coalition pledged its support for Diyala becoming a region on Thursday with the caveat that it does not include the district of Khanaqin which Kurds want to join Kurdistan.

Diyala Provincial Council KBC member Jalil Ibrahim told AKnews: "All the members of the coalition support the establishment of Diyala region on the condition that non of the other districts like Khanaqin join it."

The KBC called on the leaders of political blocs in Baghdad to support Diyala's aspirations and end the tensions that followed the province's announcement.

But the Ahrar Bloc which belongs to the hardline Shiite Sadrist movement raged that turning Diyala Province into an autonomous region is illegal.

The head of the Ahrar Bloc Bahaa al-Araji told AKnews the bid is politically motivated and the Federal Court rejected the demand since the Province includes disputed areas.

Diyala Representative Salim al-Jabbouri in the Iraqi Council of Representatives told AKnews earlier that 29 Provincial Council members, more than half the Council,www.ekurd.net signed the declaration of the Province's intention to become an administratively independent region.

Article 119 of the Iraqi constitution allows a province to become a region through a referendum requested by one third of the provincial council members or one tenth of the voters.

Over the last two months several provincial councils have declared autonomy or threatened to do so. This glut of schisms is a response to the arrests of more than 615 alleged former members of the Baath Party, especially among Sunni provinces.

The arrests were ordered by Prime Minister Nouri al-Maliki after he received information from Libyan interim leader Mahmoud Jibril. Libyan rebel forces obtained documents indicating Muammar al-Qaddafi tried to support an attempt of Baath members to overthrow the Iraqi government.

Diyala Governor urges Maliki to respect the constitution

In a statement Diyala's Provincial Council published on its website , he asked the PM Maliki to urge the armed forces to stay committed to the constitution and not to take certain political party's sides.

the statement also says using weapons against , threatening and arresting the officials which has occurred in the last few days is a clear violation of human rights and more than 40 constitutional articles cover that.

After autonomy was announced for the province alot of riots abrupted in the south part of the province specially in Khalis and Baquba, then the iraqi parliament sent a delegation to investigate the situation.

the announcement became void , because the iraqiya list was not prepared to sign kurdish demands which were the kurdish areas will not be included in this region and will be annexed to kurdistan . kurdistani bloc in the PC said they no longer support the autonomy and have withdrawn their signature thus the autonomy becomes void . he said if the iraqiya list however change their minds in the future we can work on it again and re-announce it as 7 days has passed and the demand did not make it to Ministry of councils .
